Procedural Guidance for Class Action Settlements Gets Major Update
Effective November 1, 2018, the Court has adopted revisions to the Procedural Guidance for Class Action Settlements in its ongoing efforts to provide guidance and instruction to class action practitioners.
In addition, the Standing Order For All Judges Of The Northern District Of California has been revised to require counsel in class actions to include in Joint Case Management Statements "whether all attorneys of record for the parties have reviewed the Procedural Guidance for Class Action Settlements."
The Court thanks the Northern District of California Civil Rules & Practice Committee, the FBA Ad Hoc Committee, Professor Joshua Davis (University of San Francisco), Professor Sam Issacharoff (New York University), Professor Brian Fitzpatrick (Vanderbilt University), and Professor William Rubenstein (Harvard University) for providing comments and observations on the revisions.
NOTE: On Dec 5, 2018, the Court updated the guidance to clarify the relationship between the guidance and the presiding judge's orders. ⇒ View updated Procedural Guidance for Class Action Settlements .
