Court Amends General Order Governing ADA Disability Access Cases

Effective May 29, 2012, the Court has adopted revisions to General Order 56.  This general order establishes special case management procedures governing ADA Access Litigation. The key changes:

  • provide additional time for the parties to engage in settlement discussions following the joint site inspection;
  • encourage the use of a joint expert in appropriate cases;
  • clarify that plaintiffs should not insist on a fully executed agreement before making a settlement demand and should provide documentation for any attorney's fees demands; and
  • clarify the deadline for conducting a mediation session.
