Environmental Mitigation Trust
As part of the partial consent decrees between Volkswagen, the State of California, and the United States, Volkswagen agreed to contribute approximately $2.9 billion to an Environmental Mitigation Trust to remediate excess NOx emitted by its 2.0-liter and 3.0-liter “clean diesel” vehicles. The beneficiaries of the trust are the 50 States, Puerto Rico, the District of Columbia, and the federally-recognized Indian Tribes.
The Court subsequently approved the creation of two trusts, one for Indian Tribe Beneficiaries and one for the 50 States, Puerto Rico, and the District of Columbia. As part of these trust agreements, each beneficiary was required to submit a Certification for Beneficiary Status with the Court.
