This waiver only applies to prisoner cases in this District’s prison email filing program.

Misc. Order 2019.01.25: First Step Act Of 2018; Application Of Fair Sentencing Act Of 2010 (amended 4-27-2020)

— Provides for representation for any defendant entitled to appointment of counsel to determine whether a defendant may qualify to seek reduction of sentence and to present any motions or applications for reduction of sentence in accordance with Section 404 or Section 603 of the First Step Act of 2018, Senate Bill 756 (115th), signed into law December 21, 2018.

— Presumptively appoints Federal Public Defender to represent defendants previously entitled to appointment of counsel or currently indigent in connection with seeking federal habeas relief under either 28 U.S.C. § 2255 or 28 U.S.C. § 2241 in light of Rehaif v. United States, 139 S. Ct. 2191 (2019) and United States v. Davis,139 S. Ct. 2319 (2019).
